22. Letter Providing Outcome of Disciplinary Appeal Hearing

This template letter communicates the outcome to an employee following their Disciplinary Appeal Hearing.

The model letter includes options for the decision being to: uphold the original decision; reduce the disciplinary penalty; revoke the disciplinary sanction; and reinstate the employee.

Please remember not to increase the disciplinary penalty on appeal, unless you have a specific right to in your disciplinary procedure or the employee's contract of employment (see the case of McMillan v Airedale NHS Foundation Trust 2014).  If during the course of the Appeal process it is found that the conduct/performance was of a more serious nature than originally determined, another disciplinary hearing should be held.
