The person conducting the investigation should have no connection with the allegation and appeal hearings should be Chaired by a person with no prior involvement, at any stage of the procedure. 
We must strive to ensure an impartial appeal process, although those of us in small businesses, may not have enough managers for the investigation, hearing and appeal to be conducted by different people.  It is in your interests to engage professional HR consultants, if necessary to ensure a fair process.
